Agreement
These terms are between you and Wezdenko L.L.C., an Arizona limited liability company ("we", "us"). They apply to Spotcraft™, including its app and its capture tool. Using Spotcraft means you accept these terms. If you do not accept them, please do not use it. Our general Terms of Service also apply. Where the two differ, these terms control for Spotcraft.
Identification results are informational
Spotcraft™ is a training and enthusiast tool. It identifies aircraft from images and public data, and it will sometimes be wrong.
Do not rely on it for the operation of an aircraft, for air traffic or ground control, for security or law-enforcement decisions, for maintenance or airworthiness determinations, or for any purpose where an incorrect identification could cause harm. It is not a navigational instrument, not a certified aviation product, and not a substitute for an authoritative source.
Using Spotcraft
You may use Spotcraft for its intended purpose. Please do not:
- break the law with it, or use it to harass, surveil or endanger anyone;
- capture images where photography is prohibited, or where you lack permission to be;
- interfere with the service, probe it for vulnerabilities without our written permission, or attempt to bypass access controls;
- scrape, resell or redistribute the service or its output as a competing product;
- upload content you have no right to submit.
You are responsible for what you capture and submit, and for complying with local law where you are.
Your content
The images and information you submit remain yours. Using Spotcraft, you grant us the limited permission we need to operate the service: to transmit, process, store and display your content back to you, and to have our providers do the same on our behalf.
Beyond that, two separate licenses may apply, and neither implies the other. The corpus license covers images and video entering our training collection. The social media license covers publishing a work you submit for Picture of the Week. Each is its own versioned text, shown to you before you accept it, and the version you accepted is recorded. Where these terms and a license you accepted differ, that license controls. Our Privacy Policy summarizes both.
Our content
Spotcraft™, its software and these terms are © Wezdenko L.L.C. Spotcraft™ and our other product names and logos are our trademarks, whether or not registered. These terms give you no right to use them beyond ordinary reference to Spotcraft.
Accounts
If you create an account, keep your credentials secure and tell us promptly if you believe they have been compromised. You may close your account at any time.
Availability and changes
We may change, suspend or discontinue any part of Spotcraft. These terms are versioned. If a new version materially affects you, we will give notice in the app or by email before it takes effect. Continuing to use Spotcraft after that means you accept the new version.
Paid features
Some features may be offered for a fee in future. Where they are, the price, billing period and cancellation terms will be disclosed before you are charged, and purchases made through an app store are also subject to that store's terms and refund policy.
No warranty
Spotcraft is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that identifications will be correct, or that the service will be uninterrupted or error-free. Some jurisdictions do not allow these exclusions, in which case they may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Wezdenko L.L.C. will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising out of your use of Spotcraft. Our total liability for any claim relating to Spotcraft will not exceed the greater of the amount you paid us for it in the twelve months before the claim, or twenty-five United States dollars. Some jurisdictions do not allow these limitations, in which case they may not apply to you.
Termination
You may stop using Spotcraft at any time. We may suspend or end your access if you materially breach these terms, or if we are required to. The sections that by their nature should survive termination do survive it: your content and its licenses, the warranty disclaimer, the limitation of liability and governing law.
Governing law
These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. The courts located in Maricopa County, Arizona have exclusive jurisdiction over disputes arising from them, and you and we each consent to that jurisdiction.
